The present general terms and conditions of sale govern the sale of products presented on the website www.celine-opticien-lunetier.com

Céline Roland Opticien Lunetier reserves the right to modify the present general terms and conditions of sale, it being specified that the new general terms and conditions of sale will only take effect for orders placed after the new terms and conditions have been posted online.                                                    

Céline Roland Opticien Lunetier reserves the right to modify its prices at any time, but undertakes to apply the current rates indicated at the time of your order. 

The profession of optician is a profession regulated by law.

The online sales service Céline Roland Opticien Lunetier is managed by a qualified optician. The customer can contact a Céline Roland Opticien Lunetier advisor, for any useful information and for any complaint by the online contact form available on the website www.celine-opticien-lunetier.fr, or by mail at the following address

Article 2 – Offer

The products presented on the website www.celine-opticien-lunetier.com  are described in English language, as precisely as possible. The photos representing the products are indicative and alterations may occur due to their transcription on the website of Céline Roland Opticien Lunetier.


However, if in spite of our best effort an error should happen, the customer may benefit from the guarantees provided for in Article 7 or withdraw under the conditions of Article 8.

Article 3 – Order

3.1 - The orders of products intervene exclusively on the Internet site www.celine-opticien-lunetier.fr and are delivered to the residence of the customer or with the address which it will have indicated during the process of order.

3.2 - Prior to placing any order, the customer certifies :

- to be a legally capable individual aged at least eighteen (18) years;

- to be the holder of or duly authorized to use the payment card used to pay the total amount of the order; it being specified that said payment card gives access to sufficient funds to cover the total amount of the order.

In the case of an order for corrective contact lenses, the customer certifies, by placing the order, that he/she is in possession of a medical prescription for the corrective contact lenses ordered, issued by an ophthalmologist and valid on the day of validation of the order payment.

The customer is reminded that the first delivery of corrective contact lenses requires medical supervision. The delivery of corrective contact lenses on the website www.celine-opticien-lunetier.com can only take place after adaptation by the customer's ophthalmologist and the delivery, by the latter, of an adapted medical prescription.

Article 4 – Price

4.1 - The prices of products sold on the www.celine-opticien-lunetier.fr website are indicated in euros (€), including all French taxes, and include the value-added tax (VAT) in effect on the day the Customer validates payment of the order. 

Céline Roland Opticien Lunetier reserves the right to modify the prices of the products sold on the www.celine-opticien-lunetier.com  website at any time and without prior notice; it being understood, however, that the price of the products sold on the www.celine-opticien-lunetier.com  website is the one appearing on the said website on the day the Customer confirms payment of the order. The prices of the products sold on the Internet site www.celine-opticien-lunetier.fr are exclusive of delivery charges.



4.2 - The order delivered to the customer's home or to the address indicated by the customer during the ordering process, in accordance with Article 3, is payable immediately. 

Are accepted on the website www.celine-opticien-lunetier.fr, the following means of payment:

  • We accept payments by credit card are made through the secure server of our partner Payplug

  • We accept payments by American Express through the secure server of our partner Payplug 

  1. Apple Pay:

  • PayPal is a globally recognized online payment method. If you have a PayPal account, you can use it to pay for your order in peace. By paying your order by Paypal, fees are added which are automatically calculated according to the price of your order.

  • Oney is a payment service that allows you to benefit from payment facilities via the secure server of our partner Payplug. You can choose this option when ordering. (payment in 3 or 4 times)

  1. Bancontact :

  • If you are in Belgium, you can use the Bancontact payment system to pay for your online purchases in a secure and convenient way via the secure server of our partner Payplug.

  1. Cryptocurrencies:

  • We also accept cryptocurrency payments, offering a modern and secure alternative. You can make your payment in Bitcoin, Ethereum, or any other accepted cryptocurrency.

Please note that all our transactions are secure and we do not store sensitive information related to your payment method.

4.3 - No other means of reimbursement other than that used at the time of the order will be accepted.

For certain methods of payment, we may ask you for a copy of your identity card or proof of address in order to validate your order.

 The bank account of the holder of the payment card used by the customer to pay the amount of the order will be debited from the confirmation of the order.

4.4 - Payments are made through the secure system 3DS which uses the SSL protocol (Secure Socket Layer) so that the information transmitted by the customer is encrypted by a software and that no third party can take cognizance of it during the transport on the network.

The data relating to the bank cards are used only for the purposes of carrying out the transaction. For any order on the website www.celine-opticien-lunetier.com  after validation of the payment of the said order by the customer, the latter will be sent an invoice by e-mail.

4.5 - Céline Roland Opticien Lunetier reserves the right to cancel any order with a value of 0€ or loss due to a computer problem.


4.6 - The prices displayed on the www.celine-opticien-lunetier.com  website are exclusive to online sales. Thus the prices in our points of sale can be higher.

 

Article 5 – Unavailability of products

If a product you have ordered is finally not available, we commit ourselves to take the following measures by email within 15 days of the validation of your order:

  1. Inform you of the availability time: - We will keep you informed of the expected time for the product to become available again. You can then decide to maintain your order as is while waiting for the arrival of the product.

  1. Offer you a similar product: - We will offer you a similar product, which will meet your needs and will be offered at a similar price. Thus, you will be able to choose to replace the product originally ordered with a comparable alternative.

  1. Refund: - If none of the above options are suitable, we will refund the amount of your order. You will receive a full refund of the payment made within 14 days.

 

Article 6 – Delivery

6.1 - The deliveries of the products sold on the Internet site www.celine-opticien-lunetier.fr take place in France and internationally. 

The ordered products are delivered to the customer's home or to the address indicated by the customer during the ordering process. Delivery is made by La Poste or DPD according to the customer's choice.

* Delivery is free of charge from 90 € of purchase in Metropolitan France only in relay points.

A tracking number is assigned to the customer's package, allowing him to follow the delivery process of his order. 

The customer will be informed by e-mail of the shipment of the product(s).

6.2 - The delivery of the ordered products to the customer's home or to the address indicated by the customer during the ordering process is paying.

6.3 - The delivery of the product(s) ordered by the customer, at the customer's home or at any other address indicated by the customer when placing the order will take place within a maximum of fifteen (15) days from the date of confirmation of the order. 

In the event of a delay in delivery of more than seven (7) days and except in cases of force majeure, the customer shall have the option, within sixty (60) days of the expiration of the aforementioned seven (7) day period, of requesting cancellation of the order by sending SAS ORC a registered letter with return receipt, if and only if the package has not yet been shipped.

If the sale is cancelled under the above conditions, the customer will be reimbursed in accordance with the conditions set out in Article 10 below. 

Céline Roland Opticien Lunetier reserves the right to split shipments into several packages when the customer orders several products at the same time and when these have different delivery dates. 

The delivery date of the order is deemed to be the date of the last delivery, it being understood that the flat-rate delivery fees (article 6.2 above) will only be invoiced once.

6.4 - Transport: Instructions to follow for the reception and the checking of the parcel: 

Please follow these instructions in order to benefit from possible recourse :

1 - If the packaging is in good condition, accept the package.

Check the contents of the package as soon as possible, in the presence of the carrier if possible, otherwise just after his departure. If one or more items are damaged, it is imperative to notify us within (48) hours by e-mail to the following address: contact@celine-opticien-lunetier.com or via the contact form. In addition, send a registered letter with acknowledgement of receipt to the carrier within (48) hours, specifying your contact information, the package number, the circumstances of the delivery, the reservations noted on the transport note, as well as the damaged items and their value. If you do not take these steps, your possibilities of subsequent recourse may be limited or even impossible. Also keep the packaging (the parcel) to be able to bring proof of a possible problem of transport if necessary.

2 - If the packaging is slightly damaged, indicate reservations and accept the package.

If the package shows minor damage, please note precise and detailed reservations on the transport voucher. Use the words "AVARIE" followed by a precise description of the damage. The mention "subject to unpacking" has no value.

Check the contents of the package as soon as possible, in the presence of the carrier if possible, otherwise just after its departure. If one or more items are damaged, it is imperative to notify us within 48 hours by e-mail to the following address: contact@celine-opticien-lunetier.com  or via the contact form. In addition, send a registered letter with acknowledgement of receipt to the carrier within 48 hours, specifying your contact details, the transport reference, the reservations noted on the transport note, the circumstances, as well as the damaged items and their value. If you do not take these steps, your possibilities of subsequent recourse may be limited or even impossible. Keep the packaging (the parcel) to be able to prove the transport problem if necessary and to support your reservations.

3 - If the package is badly damaged or has been opened, do not open it and refuse it.

If the package is crushed, nicked, wet, or opened and the adhesive is not original, unless you are sure that the items are in perfect condition, do not open it and refuse it! If you place an order on our site and it is delivered outside of France, please note that it may be subject to taxes and customs duties once the package reaches its destination. You are responsible for any such taxes and customs duties.

Article 7 – Guarantees

All the products sold on the website www.celine-opticien-lunetier.com benefit from legal guarantees against hidden defects and lack of conformity, provided by :

- The Civil Code and specifically the following articles: 

Article 1641 : « The seller is bound to a warranty on account to the latent defects of the thing sold which render it unfit for the use for which it was intended, or which so impair that use that the buyer would not have acquired it, or would only have given a lesser price for it, had he known of them. »

Article 1648, alinéa 1er : «The action resulting from redhibitory vices must be brought by the buyer within a period of two years following the discovery of the vice. »

- The French Consumer Code and especially the following articles:

Article L211-4 : « The seller’s obligation to deliver goods in conformity with the contract and his consequent liability in case of lacking conformity. He is also held liable for any lack of conformity caused by the packaging or the assembly instructions, or the installation if he assumed responsibility therefor or had it carried out under his responsibility. »

Article L211-5 : « To be compliant with the contract, the article must:

1° Fit for the purpose usually of a similar property and, where applicable:

-    Match the description given by the seller and possess the qualities that has presented to the buyer as a sample or a model;
-    The features that a buyer might reasonably expect given the public statements made by the seller, the producer or his representative, particularly in advertising or labeling;

2° Or have the qualities defined by common agreement by the parties or to be suitable for any particular purpose for which the buyer made known to the seller and the latter accepted. »

Article L211-12 : « Action resulting from defects to conformity lapses after two years from the date of delivery of the article. »

The client who acts in legal guarantee of conformity: 

-    Benefit from a period of two years from the date of the delivery of the product to act; 

-    Can choose between the repair or the replacement of the product, under the conditions stipulated by the article L.211-9 of the French Consumer Code; 

-    Is exempted to provide the proof of the existence of the default of conformity of the good, during the six months following the delivery of the product

Article L211-16 :  When the buyer asks the seller to carry out repairs covered by his contractual guarantee, the period of any resultant shutdown of seven days or longer shall be added to the unexpired term of the guarantee. The said period shall run from the time when the buyer requests assistance or the time when the product in question is taken out of service pending repair, should this be subsequent to the request for assistance.

The legal guarantee of conformity applies regardless of any other guarantee that Céline Roland Opticien Lunetier could consent to. 

The client can decide to initiate the guarantee against hidden defects of the product sold according to the article 1641 of the Civil Code. 

In this case, the client can choose between the cancellation of the sale or a reduction of the selling price in accordance with the article 1644 of the Civil Code. 

The guarantees above-mentioned do not apply to the products modified or repaired, in any way or by any person, other than the product supplier.

In accordance with the provisions above-mentioned, the defective products, damaged or not complying with the order can be replaced or refunded, within the limit of stocks available, after the return of the product(s), in the conditions defined in the article 9 below.

In case of impossibility to replace the product(s) ordered, the client can return the said product(s) and be refunded the price paid, in the conditions defined in the articles 9 and 10 below.

The provisions of this article shall not apply, without prejudice to the legal guarantees under the condition that the client has assessed the defect at the moment of the delivery of the product(s) and has informed the customer care department of Céline Roland Opticien Lunetier, under the conditions below.

Any claim of the buyer in conformance of the warranty of conformity laid down in the articles L.211-4 and the ones following of the French Consumer Code or of the guarantee of the defects of the sold product, within the meaning of the article 1641 of the Civil Code, has to be formulated to the customer care department of Céline Roland Opticien Lunetier whose contact details are indicated in the article 1 or by mail.

The warranty covers: 

  • manufacturing defects

  • hidden defects 

The warranty does not cover : 

  • scratches, breakage

  • damage caused by the intervention of a third party other than a Céline Roland Opticien Lunetier after-sales service optician

  • damage caused by an accident, a shock

  • damage caused by incorrect use

We can repair your glasses provided that you return them to us at your expense.

We will evaluate the damage and make an estimate for the repairs

 

Article 8 – Withdrawal

The Customer has a thirty (14) day cooling-off period from the date of receipt of the order.

The customer must inform Céline Roland Opticien Lunetier of his or her intention to withdraw by returning the product(s), in accordance with the terms of Article 9 below, in order to obtain a refund of his or her order in accordance with Article 10 below.

This article applies exclusively to products sold online in accordance with article 3.

As the reservation is not accompanied by an obligation to purchase, this article is not applicable to products reserved in accordance with Article 11.

However, according to Article L121-21-8: 

"The right of withdrawal can not be exercised for contracts for the supply of goods made to the specifications of the consumer or clearly personalized."

No exchange and no refund can be made on equipment adapted to the sight.

An anti-theft device is placed on all glasses, no retraction will be possible if the anti-theft device is removed.

Céline Roland Opticien Lunetier reserves the right to refuse to make a delivery or process an order due to technical problems with the operation of the site, including computer problems. In such cases, we will be forced to cancel the order and refund in full any funds already paid. You will receive a confirmation email to inform you of this.

Please note that if you cancel an order when the product is already ready for shipment, you will be charged a preparation fee of 15€.

Article 9 – Return

The return by the customer of the product(s), in application of articles 7 and 8 above, must be carried out according to the following procedure:

- The customer must complete the return form (including the withdrawal form).

- The customer completes the return form and attaches it to the package containing the returned product(s).

- The customer returns, within the time limit, his package containing the returned product(s) accompanied by his/their return form(s), in the following manner:

In case of return to the above-mentioned address, the shipping costs are at the charge of the customer. It is understood that the product(s) is/are returned intact, not used, in their original packing, with the cases, possible notices and all the supplied accessories.

The customer is responsible in case of depreciation of the product resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of this product.

In case of return by the customer of a product that does not meet the above conditions, or damaged, incomplete, deteriorated from its original condition or different from the initial order, the said product will not be refunded.

Please note that no refunds will be issued for frames that have been adapted to your eyesight or for a model from which the anti-theft device has been removed.

* Frames that have been customized for your eyesight do not have an anti-theft device, as they are not refundable. 

Article 10 – Refund

Products will be reimbursed within a maximum of fourteen (14) days from the date of receipt by Céline Roland Opticien Lunetier of the return form accompanied by the product(s) returned in accordance with Article 9 above. 

The refund will be made by the same method of payment used by the customer to pay for the order. 

No refund will be made on another method of payment than the one used at the time of the payment.

The fixed costs for delivery at home or at the address indicated by the customer during the ordering process, indicated in article 6.2 above, are also refunded under the same conditions.

Article 11– Reservation

11.1 - The reservation does not constitute an act of purchase and is not accompanied by an obligation to buy, the purchase in store by the customer of the product(s) reserved will take place after the establishment of an estimate in store.

The reservation does not take into account the agreements that your optician may have concluded with your complementary health insurance or mutual insurance company. Depending on these agreements, your optician is likely to propose a more suitable offer in store.

 

Article 12 – Responsibilities

The products sold on the Internet site www.celine-opticien-lunetier.com are in conformity with the French regulation. 

It is up to the customer to comply with the applicable regulations in case of use of the product(s) in a country other than France.

 

Article 13 – Intellectual property

All elements appearing on the website www.celine-opticien-lunetier.com, whether visual or audio, including the underlying technology, as well as the texts, trademarks, logos, drawings and models appearing on the site, are protected by copyright, trademarks or patents. 

Any reproduction or representation in whole or in part of said elements on the www.celine-opticien-lunetier.fr website is strictly prohibited. 

Céline Roland Opticien Lunetier holds and retains all exclusive intellectual property rights to all elements of the www.celine-opticien-lunetier.com website. No one is authorized to reproduce, exploit, rebroadcast or use, even partially, the elements of the site, whether they be software, textual, visual or audio, without the express authorization of Céline Roland Opticien Lunetier. However, hypertext links or similar links pointing to the site are authorized without requiring specific requests.

 

Article 14 – Personal Data

Data related to transactions, including medical data, will not be kept for more than 5 years

An irregular declaration or an anomaly may also be subject to specific processing.

In accordance with the Data-processing law and Freedoms of January 6, 1978 the customer has, constantly, a right of access, of correction, and opposition to the whole of his personal data by writing, by mail and by justifying his identity to :

Article 15 – Dispute resolution

The present general conditions of sale are subject to French law.

Except for amicable agreement between the parties, the French courts of the applicant's domicile are the only competent courts in case of dispute.

Article 16 – Anti-Fraud control

Céline Roland Opticien Lunetier reserves the right to verify the orders validated on its site in order to prevent any abusive practice by fraudsters. In certain situations, for example when the order has an IP address or a delivery address that is different from the billing address, our services may contact the two people concerned: the person linked to the billing address and the person indicated for the delivery address.

As part of these procedures, our services may ask you to provide the necessary supporting documents to release your order, such as proof of address in your name, a copy of your ID and proof of address in the name of the person indicated for the delivery address, etc. All these requests will be sent by e-mail.
