Article 1 - General information

The present terms and conditions of sale govern the sale of products presented on the www.celine-opticien-lunetier.frwebsite .
Céline Roland Opticien Lunetier reserves the right to modify the present terms and conditions of sale, it being understood that the new terms and conditions of sale will only take effect for orders placed after the new terms and conditions have been put online.

Céline Roland Opticien Lunetier reserves the right to modify its prices at any time, but undertakes to apply the current prices indicated at the time of your order.

The profession of optician is regulated by law.
The Céline Roland Opticien Lunetier online sales service is managed by a qualified optician. Article 2 - Offer

The products presented on the www.celine-opticien-lunetier.fr website are described in French, as accurately as possible .

The photos representing the products are indicative and alterations may occur due to their transcription on the Céline Roland Opticien Lunetier website.

However, in the event of an error, the customer may benefit from the guarantees provided for in Article 7, or withdraw under the conditions set out in Article 8.

Article 3 - Ordering

3.1 - Orders for products are placed exclusively on the www.celine-opticien-lunetier.fr website and are delivered to the customer's home address or to the address indicated during the ordering process.

3.2 - Prior to placing any order, the customer certifies :

- he/she is a legally capable individual aged at least eighteen (18) years ;
- to be the holder of, or duly authorized to use, the payment card used to pay for the total amount of the order; it being understood that said payment card gives access to sufficient funds to cover the total amount of the order.

In the case of orders for corrective contact lenses, the customer certifies, by placing the order, that he/she is in possession of a medical prescription for the corrective contact lenses ordered, issued by an ophthalmologist and valid on the day the payment for the order is validated.
Customers are reminded that the first delivery of corrective contact lenses requires medical supervision. Corrective contact lenses may only be delivered via the www.celine-opticien-lunetier.fr website once they have been adapted by the customer's ophthalmologist, who has issued a suitable medical prescription.

Article 4 - Prices

4.1 - The prices of products sold on the www.celine-opticien-lunetier.fr website are indicated in euros (€), including all French taxes, and include the value-added tax (VAT) in force on the day the customer confirms payment of the order.
Céline Roland Opticien Lunetier reserves the right to modify the prices of products sold on the www.celine-opticien-lunetier.fr website at any time and without prior notice; it being understood, however, that the current price of products sold on the www.celine-opticien-lunetier.fr website is that shown on the website on the day the customer confirms payment for the order. The prices of products sold on the www.celine-opticien-lunetier.fr website do not include delivery charges.

4.2 - Orders delivered to the customer's home address or to the address indicated by the customer during the ordering process, in accordance with article 3, are payable immediately.

The following means of payment are accepted on the www.celine-opticien-lunetier.frwebsite :

  • Credit card: We accept credit card payments via the secure server of our partner Payplug
  • American Express: We accept American Express payments via the secure server of our partner Payplug
  • Apple Pay: Apple users can take advantage of the simplicity and security of Apple Pay to pay for their purchases via the secure server of our partner Payplug
  • PayPal: PayPal is a world-renowned online payment method. If you have a PayPal account, you can use it to pay for your order with complete peace of mind. When you pay by Paypal, a fee is added which is automatically calculated according to the price of your order.
  • Oney: Oney is a payment service which allows you to benefit from payment facilities via the secure server of our partner Payplug. You can choose this option when you place your order. (payment in 3 or 4 instalments)
  • Bancontact: If you are in Belgium, you can use the Bancontact payment system to pay for your online purchases securely and conveniently via the secure server of our partner Payplug.
  • Cryptocurrencies: We also accept payment by cryptocurrency, offering a modern and secure alternative. You can pay in Bitcoin, Ethereum or any other accepted cryptocurrency.

Please note that all our transactions are secure and that we do not store any sensitive information related to your payment method.

4.3 - No other means of reimbursement other than the one used at the time of ordering will be accepted.

For certain methods of payment, we may ask you for a copy of your ID or proof of address in order to validate your order.

The bank account of the holder of the payment card used by the customer to pay for the order will be debited as soon as the order is confirmed.

4.4 - Payments are made via the 3DS secure system, which uses the SSL (Secure Socket Layer) protocol so that information transmitted by the customer is encrypted by software and cannot be read by any third party during transport on the network.

Credit card details are only used to complete the transaction. For all orders placed on the www.celine-opticien-lunetier.fr website, an invoice will be sent to the customer by e-mail once payment has been confirmed.

4.5 - Céline Roland Opticien Lunetier reserves the right to cancel any order with a value of 0€ or loss due to a computer problem.

4.6 - Prices displayed on the www.celine-opticien-lunetier.frwebsite are exclusive to online sales. Prices in our outlets may therefore be higher.

Article 5 - Unavailability of products

If a product that you have ordered is finally unavailable, we undertake to take the following measures by e-mail within 15 days of the validation of your order:

  • Inform you of the availability time : We will keep you informed of the expected time for the product to become available again. You may then decide to maintain your order as is until the product arrives.
  • Offer you a similar product: We will offer you a similar product that meets your needs and is offered at a similar price. In this way, you can choose to replace the product originally ordered with a comparable alternative.
  • Refund: If none of the above options are suitable, we will refund the amount of your order. You will receive a full refund of the payment made within 14 days.

Article 6 - Delivery

6.1 - Products sold on the www.celine-opticien-lunetier.fr website are delivered in France and abroad.
Products ordered are delivered to the customer's home address or to the address indicated by the customer during the order process. Delivery is made by Chronopost, DHL or partners.

* In France, our delivery fee is set at €12. Delivery is free to a pickup point for orders over €90 in France.

A tracking number is assigned to the customer's parcel, enabling him to follow the delivery process of his order.
The customer will be informed by e-mail of the shipment of the product(s).

6.2 - Delivery of products ordered to the customer's home or to the address indicated by the customer during the order process is subject to a charge.

* A change of address for a parcel that has already been dispatched will incur a €6 charge.

6.3 - Delivery times are not specifically defined and may vary according to circumstances. The customer will be informed of the estimated delivery time when the order is confirmed.
In the event of a delay in delivery of more than seven (7) days and except in cases of force majeure, the customer will have the possibility, within sixty (60) days of the expiry of the aforementioned period of seven (7) days, of requesting the cancellation of his order, by sending SAS OCR a registered letter with acknowledgement of receipt. If and only if the parcel has not yet been dispatched.
In the event of cancellation of the sale under the aforementioned conditions, the customer will be reimbursed under the conditions of article 10 below.
Céline Roland Opticien Lunetier reserves the right to split shipments into several parcels, when the customer orders several products at the same time and these have different delivery dates.
The delivery date of the order is deemed to be the date of the last delivery, it being understood that the flat-rate delivery charges (article 6.2 above) will only be invoiced once.

6.4 - Transport: Instructions for receiving and checking the parcel:

Please follow these instructions in order to benefit from any possible recourse:

1 - If the packaging is in good condition, accept the parcel.

Check the contents of the package as soon as possible, in the presence of the carrier if possible, otherwise immediately after departure. If one or more items are damaged, it is imperative that you notify us within (48) hours by e-mail to the following address: [email protected] or via the contact form. In addition, send a registered letter with acknowledgement of receipt to the carrier within (48) hours, specifying your contact details, the parcel number, the circumstances of the delivery, the reservations noted on the delivery note, as well as the damaged items and their value. Failure to do so may limit or even preclude any subsequent recourse. You should also keep the packaging (the parcel) so that you can provide proof of any transport problems if necessary.

2 - If the packaging is slightly damaged, express your reservations and accept the package.

If the package shows minor damage, please note precise and detailed reservations on the transport note. Use the words "AVARIE" followed by a precise description of the damage. The words "subject to unpacking" have no value.

Check the contents of the package as soon as possible, in the presence of the carrier if possible, otherwise immediately after departure. If one or more items are damaged, it is imperative that you notify us within 48 hours by e-mail to the following address: [email protected] or via the contact form. In addition, send a registered letter with acknowledgement of receipt to the carrier within 48 hours, specifying your contact details, the transport reference, the reservations noted on the delivery note, the circumstances, as well as the damaged items and their value. If you do not take these steps, your possibilities of subsequent recourse may be limited, if not impossible. Keep the packaging (the parcel) to be able to provide proof of the transport problem if necessary, and to support your reservations.

3 - If the packaging is badly damaged or has been opened, do not open it and refuse it.

If the package is crushed, nicked, wet, or if it has been opened and the adhesive is not original, unless you are certain that the items are in perfect condition, do not open it and refuse it! If you place an order on our site and it is delivered outside mainland France, please note that it may be subject to taxes and customs duties once the package reaches its destination. Any customs duties and taxes are your responsibility.

Customs duties and returns policy The customer is responsible for paying all applicable customs duties and taxes related to the import of the products, directly to the appropriate authorities in his/her country (customs). Return shipping costs, if any, are also the responsibility of the customer and will be deducted from the refund.

Article 7 - Warranties

All products sold on the www.celine-opticien-lunetier.fr website are covered by the legal warranties against hidden defects and lack of conformity, as provided for by :

- The French Civil Code, and in particular the following articles:

Article 1641: "The seller is liable for any hidden defects in the item sold which render it unsuitable for its intended use, or which impair this use to such an extent that the buyer would not have purchased it, or would only have paid a lower price for it, if he had known of them.

Article 1648, paragraph 1: "The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect.

- The French Consumer Code, and in particular the following articles:

Article L211-4: "The seller is required to deliver goods in conformity with the contract and is liable for any defects in conformity existing at the time of delivery. He is also liable for defects in conformity resulting from the packaging, assembly instructions or installation when the latter has been made his responsibility by the contract or has been carried out under his responsibility."

Article L211-5: "To conform to the contract, the goods must :

1° Be fit for the use normally expected of similar goods and, where applicable :

- correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model ;
- have the qualities that a buyer may legitimately expect, having regard to public statements made by the seller, the producer or his representative, particularly in advertising or labelling;

2° Or have the characteristics defined by mutual agreement between the parties, or be suitable for any special use sought by the buyer, brought to the seller's attention and accepted by the latter."

Article L211-12: "Any action resulting from a lack of conformity shall be barred after two years from the date of delivery of the goods."

The customer acting under the legal warranty of conformity:

-

has a period of 2 years from delivery of the product to take action;

-

can choose between repair or replacement of the product, subject to the conditions set out in article L.211-9

of the French Consumer Code;

- is exempted from proving the existence of a lack of conformity for a period of six months following delivery of the product.

Article L211-16: When the buyer asks the seller, during the course of the commercial warranty granted to him at the time of the purchase or repair of a movable good, for a repair covered by the warranty, any period of immobilization of at least seven days is added to the duration of the warranty which remained to run. This period runs from the date of the buyer's request for service or from the date the item in question is made available for repair, if the item is made available after the request for service.

The legal warranty of conformity applies independently of any other warranty that may be granted by Céline Roland Opticien Lunetier.

The customer may decide to invoke the warranty against hiddendefects in the item sold, as defined in Article 1641 of the French Civil Code.

In this case, the customer may choose between rescission of the sale or a reduction in the sale price, in accordance with Article 1644 of the French Civil Code.

The above-mentioned warranties do not apply to products modified or repaired in any way by any person other than the supplier of the product.

In application of the above provisions, defective, damaged or non-conforming products may be replaced or reimbursed, within the limits of available stocks, after return of the product(s), under the conditions defined in article 9 below.

If it is impossible to replace the product(s) ordered, the customer may return said product(s) and be reimbursed for the price paid, under the conditions defined in articles 9 and 10 below.

The provisions of the present article apply, without prejudice to legal guarantees, only if the customer has noted the defect at the time of delivery of the product(s) and has informed Céline Roland Opticien Lunetier's customer service department, in accordance with the conditions below.

Any claim by the customer under the legal warranty of conformity provided for in Articles L.211-4 et seq. of the French Consumer Code, or under the warranty for defects in the item sold, as defined in Article 1641 of the French Civil Code, must be made to Céline Roland Opticien Lunetier customer service, whose contact details are given in Article 1, or by post.

The warranty covers :

  • manufacturing defects

  • hidden defects

The warranty does not cover :

  • scratches, breakages

  • damage caused by the intervention of a third party other than a Céline Roland Opticien Lunetier after-sales service optician

  • damage caused by an accident, shock

  • damage caused by incorrect use

We can repair your glasses if you return them to us at your own expense.

We will assess the damage and quote for repairs.

Article 8 - Withdrawal

The customer has a 14-day right of withdrawal from the date of receipt of the order.

The customer must inform Céline Roland Opticien Lunetier of his/her intention to withdraw by returning the product(s), in accordance with the conditions of Article 9 below, in order to obtain a refund of his/her order in application of Article 10 below.

This article applies exclusively to products sold online in accordance with article 3.

As reservation does not imply an obligation to purchase, this article does not apply to products reserved in accordance with article 11.

However, in accordance with Article L121-21-8 :

"The right of withdrawal cannot be exercised for contracts for the supply of goods made to the consumer's specifications or clearly personalized."

No exchange or refund can be made on equipment adapted for eyesight.

An anti-theft device is fitted to all glasses. No retraction will be possible if the anti-theft device is removed.

Céline Roland Opticien Lunetier reserves the right to refuse to make a delivery or process an order due to technical problems related to the operation of the site, including computer problems. In such cases, we will be obliged to cancel the order and refund in full any funds already paid. You will receive a confirmation e-mail to inform you of this.

Please note that if you cancel an order when the product is ready for dispatch, you will be charged a €15 preparation fee.

Article 9 - Returns

The return by the customer of the product(s), in application of articles 7 and 8 above, must be carried out in accordance with the following procedure:

- The customer must complete the return form (including the retraction form).

- The customer completes the returns form and encloses it with the package containing the returned product(s).

- The customer returns the parcel containing the returned product(s), together with his or her return slip(s), within the allotted time, as follows:

- The customer returns the parcel by recorded delivery with acknowledgement of receipt to the following address:

In the event of a return to the above address, shipping costs are at the customer's expense. It is understood that the product(s) is/are returned intact, unused, in their original packaging, with the cases, any notices and all accessories supplied.

The customer is responsible for any depreciation of the product resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the product.

In the event of return by the customer of a product that does not meet the above conditions, or that is damaged, incomplete, deteriorated in relation to its original condition or different from the initial order, the said product will not be reimbursed.

Please note that no refunds will be made for frames adapted to your eyesight or for models from which the anti-theft device has been removed.

If you refuse to accept your parcel or if it is returned to us for any reason, we will charge you for the cost of returning it.

* Frames and lenses adapted to your eyesight do not have an anti-theft device, as they are non-refundable.

Return and refund conditions : Returns not claimed within 14 days of receipt of the product will be refunded in full for the amount of the glasses. However, delivery charges will be deducted as follows:

For delivery to a relay point: €6.00 will be deducted from the refund. For home delivery: €12 will be deducted from the refund.

Return costs

If your parcel is returned to our premises, this means that you have not accepted or collected it. In this case, additional charges will apply: in France, a supplement of 9 euros will be added to the delivery charge. In Europe, this supplement will be 20 euros, and internationally, a supplement of 45 euros will be added to the delivery charge (Switzerland, Norway and the UK are considered to be international).

For deliveries to Corsica, a supplement of €25.60 will be added to the cost of Classic delivery and a supplement of €22.60 will be added to the cost of Chrono 18 delivery.

These costs will be automatically deducted from the amount refunded.

If the safety clip is removed from the glasses when you return them, we will not be able to issue a refund.

For international returns, the customer must indicate that the package is being returned by sender. Failure to do so will result in the package being refused and returned to sender.

Article 10 - Refunds

Products will be reimbursed within a maximum of fourteen (14) days from receipt by Céline Roland Opticien Lunetier of the return slip accompanied by the product(s) returned in accordance with Article 9 above.

Refunds will be made by the same method of payment used by the customer to pay for the order.

No reimbursement will be made using a method of payment other than the one used for payment.

The flat-rate charges for home delivery or delivery to the address indicated by the customer during the order process, as indicated in article 6.2 above, are also reimbursed under the same conditions.

Article 11 - Booking

11.1 - As a reservation does not constitute an act of purchase and does not entail any obligation to buy, the customer's in-store purchase of the reserved product(s) will take place after an in-store quotation has been drawn up.

Reservations do not take into account any agreements your optician may have made with your complementary health insurance or mutual insurance company. Depending on these agreements, your optician may be able to offer you a more suitable package in-store.

Article 12 - Liability

The products sold on the www.celine-opticien-lunetier.fr website comply with French regulations.

It is the customer's responsibility to comply with applicable regulations in the event of use of the product(s) in a country other than France.

Article 13 - Intellectual property

All elements on the www.celine-opticien-lunetier.fr website, whether visual or audio, including the underlying technology, as well as texts, trademarks, logos, designs and models appearing on the site, are protected by copyright, trademarks or patents.

Any reproduction or representation, in whole or in part, of the aforementioned elements on the www.celine-opticien-lunetier.frwebsite is strictly forbidden .

Céline Roland Opticien Lunetier holds and retains all exclusive intellectual property rights to all elements of the www.celine-opticien-lunetier.frwebsite. No person is authorized to reproduce, exploit, rebroadcast or use, even partially, the elements of the site, whether software, textual, visual or sound, without the express authorization of Céline Roland Opticien Lunetier. However, hypertext or similar links to the site are authorized without specific request.

Article 14 - Personal data

Data relating to transactions carried out, in particular medical data, will not be kept for more than 5 years.

Any irregular declaration or anomaly may also be subject to specific processing.

In accordance with the French Data Protection Act of January 6, 1978, customers have the right to access, rectify and object to all their personal data at any time, by writing a letter, with proof of identity, to :

Article 15 - Dispute resolution

The present general conditions of sale are subject to French law.

In the absence of amicable agreement between the parties, the French courts of the claimant's domicile shall have sole jurisdiction in the event of a dispute.

Article 16 - Anti-fraud controls

Céline Roland Opticien Lunetier reserves the right to check orders validated on its site in order to prevent any abuse by fraudsters. In certain situations, for example when the order has an IP address or a delivery address different from the billing address, our services may contact the two people concerned: the person linked to the billing address and the person indicated for the delivery address.

As part of these procedures, our services may ask you to provide the supporting documents necessary to unblock your order, such as proof of address in your name, a copy of your identity document and proof of address in the name of the person indicated for the delivery address, etc. All such requests will be sent by e-mail to the address indicated for the delivery address. All such requests will be sent by e-mail.

Article 17 - Mediation

All consumer customers have the right to have recourse, free of charge, to a consumer mediator for the amicable resolution of contractual disputes concerning the performance of a contract for the supply of goods or services. Information on how to initiate mediation is available at www.economie.gouv.fr/mediation-conso.

In the event of a dispute between the professional and the consumer, they will endeavor to find an amicable solution. Failing amicable settlement, the consumer may refer the matter free of charge to the professional's consumer mediator, the MCCA (Médiation du Commerce Coopératif Associé).
